Inleiding

Dit Privacybeleid handelt over onze praktijken met betrekking tot gegevens die zijn verzameld van gebruikers die toegang krijgen tot onze website via www.marcterreur.com ('Site'), of die anderszins persoonsgegevens met ons delen (samen: 'Gebruikers'). 

Redenen voor gegevensverzameling 

Het verwerken van uw persoonsgegevens (d.w.z. alle informatie aan de hand waarvan uw identiteit mogelijk kan worden vastgesteld met behulp van redelijke middelen; hierna: 'Persoonsgegevens') is nodig voor het nakomen van onze contractuele verplichtingen die wij jegens u zijn aangegaan en voor het leveren van onze services aan u, om onze rechtmatige belangen te beschermen en om de voor ons geldende financiële en wettelijke verplichtingen na te leven.


Wanneer u gebruikmaakt van de Site, geeft u toestemming voor het verzamelen, opslaan, gebruik, openbaarmaking en ander gebruik van uw Persoonsgegevens zoals staat beschreven in dit Privacybeleid.



We raden onze Gebruikers aan om het Privacybeleid zorgvuldig door te lezen en om het te gebruiken voor het nemen van weloverwogen beslissingen. 

Wat voor gegevens verzamelen we?

Wij verzamelen twee typen gegevens en informatie van Gebruikers. 


Het eerste type informatie is niet-geïdentificeerde en niet-identificeerbare informatie met betrekking tot een of meerdere Gebruiker(s), die beschikbaar kan worden gesteld of worden verzameld doordat u de Site gebruikt (' Niet-persoonsgegevens '). We zijn niet op de hoogte van de identiteit van een Gebruiker waarvan Niet-persoonsgegevens zijn verzameld. Bij de Niet-persoonsgegevens die worden verzameld, kan het gaan om samengevoegde gegevens over uw gebruik en technische gegevens die door uw apparaat worden doorgegeven, inclusief bepaalde software- en hardwaregegevens (bijv. over de browser en het besturingssysteem dat uw apparaat gebruikt, uw taalvoorkeur, toegangstijd, etc.) om de functionaliteit van onze Site te verbeteren. We kunnen ook informatie verzamelen over uw activiteiten op de Site (bijv. over de pagina's die u hebt bekeken, uw surfgedrag, klikken, acties, etc.).


Het tweede type informatie betreft Persoonsgegevens .
Dit is individueel identificeerbare informatie aan de hand waarvan een persoon kan worden achterhaald, al dan niet door een redelijke inspanning. Bij dit type informatie gaat het om:

 

  • Apparaatinformatie: Wij verzamelen Persoonsgegevens van uw apparaat. Bij deze gegevens kan het gaan om locatiegegevens, IP-adressen, unieke identifiers (bijv. MAC-adres en UUID) en andere informatie die te maken heeft met uw activiteiten via de site.

  • Registratie-informatie: Wanneer u zich bij onze Site registreert, vragen wij u naar bepaalde informatie, zoals: volledige naam, e-mailadres of fysiek adres en andere informatie.  


Hoe ontvangen we informatie over u?

Wij ontvangen uw persoonsgegevens uit verschillende bronnen:

 

  • Wanneer u vrijwillig persoonsgegevens aan ons verstrekt om u te registreren op onze Site;


  • Wanneer u gebruikmaakt van of toegang hebt tot onze Site in verband met uw gebruik van onze services;


  • Van externe leveranciers, services en openbare registers (zoals aanbieders van verkeersanalyses).


Wat voor gegevens verzamelen we?

We verhuren, verkopen of delen informatie van Gebruikers niet met derden, behalve zoals wordt beschreven in dit Privacybeleid.


We kunnen de informatie gebruiken voor de volgende doeleinden:


  • Met u communiceren – om berichten over onze services naar u te verzenden, om u technische informatie te geven en om te reageren op uw eventuele problemen met de klantenservice;


  • Om met u te communiceren en om u op de hoogte te houden van onze nieuwste updates en services;


  • Om advertenties aan u te tonen wanneer u onze Site gebruikt (zie 'Advertenties' voor meer informatie); 


  • Om onze websites en producten te verkopen (zie 'Marketing' voor meer informatie); 


  • Voor statistische en analysedoeleinden, om de site te verbeteren.

We gebruiken Persoonsgegevens niet alleen voor de hierboven vermelde toepassingen, maar dragen deze gegevens ook over en verstrekken deze aan onze dochterondernemingen, gelieerde bedrijven en subcontractanten.


Behalve voor de doeleinden die in dit Privacybeleid worden vermeld, kunnen we ook Persoonsgegevens delen met onze vertrouwde externe leveranciers, die mogelijk in andere rechtsgebieden over de hele wereld zijn gevestigd. Dit kunnen we doen voor de volgende doeleinden: 

 

  • Het hosten en beheren van onze Site;


  • Om onze services aan u te kunnen leveren, waaronder een gepersonaliseerde weergave van onze Site;


  • Om zelf zulke gegevens op te slaan en te verwerken; 


  • Om u advertenties te tonen en om het succes van onze reclamecampagnes te kunnen evalueren en om onze gebruikers opnieuw te kunnen benaderen;


  • Om u te voorzien van reclameaanbiedingen en reclamemateriaal met betrekking tot onze Site en services; 


  • Om onderzoek te doen, technische diagnoses te stellen of analyses uit te voeren;

We kunnen ook informatie openbaar maken als wij in goed vertrouwen geloven dat het nuttig of redelijkerwijs noodzakelijk is om deze informatie te delen om: (i) van toepassing zijnde wetgeving, regelgeving, juridische procedures of overheidsverzoeken na te leven; (ii) onze beleidsmaatregelen (inclusief onze Overeenkomst) te handhaven en mogelijke schendingen daarvan te onderzoeken; (iii) illegale activiteiten of andere overtredingen, vermeende gevallen van fraude of problemen met de veiligheid te onderzoeken, op te sporen, te voorkomen of aan te pakken; (iv) onze rechten om ons te verdedigen tegen juridische claims vast te stellen en uit te oefenen; (v) te voorkomen dat de rechten, eigendommen of veiligheid van ons, onze gebruikers, u of een derde worden geschaad; of voor (vi) samenwerking met wetshandhavingsinstanties en/of in geval dat wij het nodig vinden om intellectuele-eigendomsrechten of andere rechten uit te oefenen.

Gebruikersrechten

U kunt: 

 


  • Vragen om bevestiging over of er al dan niet persoonsgegevens over u worden verwerkt en toegang tot uw opgeslagen persoonsgegevens, samen met aanvullende informatie. 


  • Vragen om een overzicht van de persoonsgegevens die u vrijwillig aan ons hebt verstrekt, in een gestructureerd, gangbaar en machineleesbaar formaat. 


  • Ons verzoeken de persoonsgegevens die wij van u in bezit hebben, te corrigeren.


  • Ons verzoeken uw persoonsgegevens te verwijderen. 


  • Bezwaar maken tegen het verwerken van persoonsgegevens door ons. 


  • Ons verzoeken het verwerken van uw persoonsgegevens te beperken.


  • Een klacht indienen bij een toezichthoudende instantie.



Deze rechten zijn echter niet absoluut en kunnen onderhevig zijn aan onze eigen rechtmatige belangen en wettelijke vereisten.

Bewaren

We bewaren uw persoonsgegevens zolang dat nodig is om onze services te leveren en om onze wettelijke verplichtingen na te leven, geschillen te beslechten en onze beleidsmaatregelen te handhaven. Bij het bepalen van de bewaartermijnen wordt er rekening gehouden met het type informatie dat wordt verzameld en met het doel waarvoor die informatie wordt verzameld, met het oog op de vereisten die van toepassing zijn op de situatie en de noodzaak om verouderde, ongebruikte informatie zo snel mogelijk te vernietigen. Wij houden dossiers bij met persoonsgegevens van klanten, documenten over het openen van rekeningen, berichten en andere zaken zoals dit door wetten en regels wordt vereist. 


We kunnen onvolledige of onjuiste informatie te allen tijde en naar uw eigen inzicht corrigeren, aanvullen of verwijderen.

Cookies

Wij en onze vertrouwde partners maken gebruik van cookies en andere technologieën in onze verwante services, ook wanneer u onze Site bezoekt of gebruikmaakt van onze services. 


Een 'cookie' is een klein stukje informatie dat een website aan uw apparaat geeft wanneer u een website bekijkt. Cookies zijn erg nuttig en kunnen voor veel verschillende doeleinden worden gebruikt. Zo kunnen ze u helpen door u efficiënt van pagina naar pagina te laten navigeren, door bepaalde functies automatisch te activeren, door uw voorkeuren te onthouden en door de interactie tussen u en onze Services sneller en gemakkelijker te laten verlopen. De Site maakt gebruik van de volgende soorten cookies:


a. 'sessiecookies' die slechts tijdelijk worden opgeslagen tijdens een internetsessie, zodat u het systeem normaal kunt gebruiken. Deze cookies worden van uw apparaat verwijderd als de browser wordt afgesloten; 


b. 'permanente cookies ' die alleen door de Site worden gelezen, voor een bepaalde periode op uw computer worden opgeslagen en niet worden verwijderd als de browser wordt afgesloten. Deze cookies worden gebruikt als we voor herhaalbezoeken moeten weten wie u bent, zodat we bijvoorbeeld uw voorkeuren kunnen opslaan voor de volgende keer dat u zich aanmeldt; 


c. 'cookies van derden' die worden ingesteld door andere online services die inhoud verzorgen op een pagina die u bekijkt, bijvoorbeeld door externe bedrijven voor gegevensanalyse die onze webtoegang controleren en analyseren.


Cookies bevatten geen informatie aan de hand waarvan uw persoonlijke identiteit kan worden vastgesteld, maar de Persoonsgegevens die we van u opslaan, kunnen wel door ons worden gekoppeld aan de informatie die staat opgeslagen in en die is verkregen door cookies. U kunt de cookies verwijderen door de instructies van uw apparaatvoorkeuren te volgen, maar als u ervoor kiest om cookies uit te schakelen, kan het gebeuren dat bepaalde functies op onze site niet goed werken en kan uw ervaring online beperkt zijn.


We maken ook gebruik van een tool met de naam 'Google Analytics' om informatie te verzamelen over uw gebruik van de Site. Google Analytics verzamelt informatie over hoe vaak gebruikers naar de Site toe gaan, welke pagina's ze dan bezoeken, enzovoort. De informatie die we van Google Analytics krijgen, gebruiken we om onze Site en services te verbeteren. Google Analytics verzamelt uw IP-adres op de dag dat u sites bezoekt, in plaats van uw naam of andere informatie die kan worden gebruikt om uw identiteit vast te stellen. De informatie die we met behulp van Google Analytics hebben verzameld, combineren we niet met persoonsgegevens. De mogelijkheid die Google heeft voor het gebruiken en delen van de informatie die Google Analytics over uw bezoeken aan deze Site heeft verzameld, wordt beperkt door de Gebruiksvoorwaarden
van Google Analytics en het Privacybeleid van Google .

Verzameling van informatie door derden

Ons beleid gaat uitsluitend over het gebruik en de openbaarmaking van informatie die we van u verzamelen. Als u uw gegevens aan andere partijen of op andere sites op het internet vrijgeeft, kunnen er andere regels van toepassing zijn op hun gebruik of openbaarmaking van de informatie die u aan hen hebt verstrekt. Daarom moedigen wij u aan om de algemene voorwaarden door te lezen van alle externe partijen waaraan u informatie verstrekt. 


Dit Privacybeleid is niet van toepassing op de praktijken van bedrijven die wij niet bezitten of beheren of van personen die wij niet in dienst hebben of leiden, inclusief de externe partijen waaraan wij informatie verstrekken zoals uiteengezet in dit Privacybeleid. 

Hoe beschermen we uw gegevens?

Met grote zorg implementeren en onderhouden we de beveiliging van de Site en van uw informatie.  Hoewel wij alle redelijke stappen ondernemen om alle gegevens te beschermen, kunnen wij geen verantwoordelijkheid dragen voor het handelen van personen die ongeoorloofde toegang verkrijgen tot of misbruik maken van onze Site en wij kunnen, impliciet, expliciet noch anderszins, garanderen dat wij dergelijke toegang zullen voorkomen.

Overdracht van gegevens buiten de EER 

Let op: sommige ontvangers van gegevens zijn buiten de EER gevestigd. In dergelijke gevallen delen we uw gegevens alleen met landen die door de Europese Commissie zijn goedgekeurd als landen die gegevensbescherming op een adequaat niveau bieden of sluiten we een wettelijke overeenkomst om gegevensbescherming op een adequaat niveau te garanderen.

Advertenties

We kunnen reclametechnologie van derden gebruiken om advertenties aan te bieden wanneer u de Site gebruikt. Deze technologie maakt gebruik van informatie met betrekking tot uw gebruik van de Services om u advertenties te kunnen aanbieden (bijv. door cookies van derden in uw webbrowser te plaatsen). 


Voor veel externe advertentienetwerken kunt u zich afmelden, waaronder voor de netwerken die worden beheerd door leden van het Network Advertising Initiative ('NAI') en de Digital Advertising Alliance ('DAA'). Marketing

We kunnen uw Persoonsgegevens, zoals uw naam e-mailadres, telefoonnummer, enzovoort zelf gebruiken of met behulp van onze externe subcontractanten om u reclamemateriaal met betrekking tot onze services te kunnen aanbieden waarvan wij denken dat u erin bent geïnteresseerd. 


Uit respect voor uw recht op privacy bieden we u binnen deze reclamematerialen de mogelijkheid om aan te geven dat u in de toekomst geen reclameaanbiedingen meer van ons wilt ontvangen. Als u zich afmeldt, verwijderen wij uw e-mailadres of telefoonnummer uit onze reclamelijst.  


Let op: zelfs als u zich hebt uitgeschreven voor onze reclamemails, kunnen wij u andere belangrijke e-mailberichten sturen waarvoor wij u niet de mogelijkheid bieden om u uit te schrijven. Hierbij kan het gaan om klantenserviceberichten of administratieve mededelingen.

Zakelijke transactie

We kunnen informatie delen in geval van een zakelijke transactie (bijv. de verkoop van een aanzienlijk deel van ons bedrijf, een fusie, een consolidatie of de verkoop van activa). Mocht zo'n geval zich voordoen, dan neemt de begunstigde of de overnemende onderneming de rechten en plichten op zich zoals die staan vermeld in het Privacybeleid.

Minderjarigen

We begrijpen hoe belangrijk het is om de privacy van kinderen te beschermen, zeker online. De Site is niet bedoeld voor of gericht op kinderen. Onder geen beding zullen we het gebruik van onze services door minderjarigen toestaan als zij hiervoor geen voorafgaande toestemming hebben van een ouder of wettelijke voogd. Wij verzamelen niet opzettelijk Persoonsgegevens van minderjarigen. Als een ouder of voogd ontdekt dat zijn of haar kind zonder toestemming Persoonsgegevens aan ons heeft verstrekt, dient hij of zij contact met ons op te nemen via marc.terreur@telenet.be.

Updates of wijzigingen van dit Privacybeleid

We behouden ons het recht voor om het Privacybeleid periodiek aan te passen of te herzien. Wezenlijke veranderingen worden onmiddellijk van kracht op het moment dat het herziene Privacybeleid wordt gepubliceerd. De nieuwste versie wordt weergegeven in de sectie 'Voor het laatst gewijzigd'. Als u na de kennisgeving van dit soort wijzigingen op onze website gebruik blijft maken van het Platform, betekent dit dat u deze wijzigingen aan het Privacybeleid erkent en goedkeurt en dat u akkoord gaat met de voorwaarden van deze wijzigingen.

Introduction

This Privacy Policy addresses our practices with respect to data collected from users who access our website at www.marcterreur.com ("Site"), or who otherwise share personal data with us (collectively, "Users"). 

Reasons for data collection 

The processing of your Personal Data (i.e. any information from which your identity could possibly be ascertained by reasonable means; hereinafter: 'Personal Data') is necessary for the performance of our contractual obligations that we have entered into with you and for providing our services to you, to protect our legitimate interests and to comply with financial and legal obligations applicable to us.


When you use the Site, you consent to the collection, storage, use, disclosure and other use of your Personal Information as described in this Privacy Policy.


We encourage our Users to read the Privacy Policy carefully and to use it to make informed decisions. 

What kind of data do we collect?

We collect two types of data and information from Users. 


The first type of information is unidentified and non-identifiable information relating to one or more User(s), which may be made available or collected as a result of you using the Site (''Non-Personal Data''). We are not aware of the identity of any User from whom Non-Personal Data is collected. The Non-Personal Data collected may include aggregate data about your usage and technical data transmitted by your device, including certain software and hardware data (e.g., about the browser and operating system your device uses, your language preference, access time, etc.) to improve the functionality of our Site. We may also collect information about your activities on the Site (e.g., about the pages you viewed, your browsing habits, clicks, actions, etc.).


The second type of information is Personal Information .

How do we receive information about you?

We receive your personal information from a variety of sources:

What kind of information do we collect?

We do not rent, sell or share Users' information with third parties except as described in this Privacy Policy.

User's Rights

  • Request confirmation on whether or not personal data about you is being processed and access to your stored personal data, along with additional information. 


  • Request an overview of the personal data you have voluntarily provided to us, in a structured, common and machine-readable format. 


  • Request us to correct the personal data we hold about you.


  • Request us to delete your personal data. 


  • Object to the processing of personal data by us. 


  • Request us to restrict the processing of your personal data.


  • File a complaint with a supervisory authority.



However, these rights are not absolute and may be subject to our own legitimate interests and legal requirements.

Storage

We store your personal information as long as necessary to provide our services and to comply with our legal obligations, resolve disputes and enforce our policies. Retention periods are determined taking into account the type of information collected and the purpose for which it is collected, in view of the requirements applicable to the situation and the need to destroy outdated, unused information as soon as possible. We maintain records of customer personal information, account opening documents, notices and other items as required by laws and regulations.


We may correct, supplement or delete incomplete or inaccurate information at any time and at your discretion.

Cookies

We and our trusted partners use cookies and other technologies in our related services, including when you visit our Site or use our services. 


A "cookie" is a small piece of information that a website provides to your device when you view a website. Cookies are very useful and can be used for many different purposes. Collection of information by third parties

Our policy only addresses the use and disclosure of information we collect from you. If you disclose your information to other parties or on other sites on the Internet, different rules may apply to their use or disclosure of the information you have provided to them. Therefore, we encourage you to read the terms and conditions of any third parties to whom you provide information.


This Privacy Policy does not apply to the practices of companies that we do not own or control or of individuals that we do not employ or direct, including the outside parties to whom we provide information as set forth in this Privacy Policy. 

How do we protect your data?

It is with great care that we implement and maintain the security of the Site and your information. While we take all reasonable steps to protect all information, we cannot be responsible for the actions of any person who obtains unauthorized access to or misuses our Site, and we cannot guarantee, either implicitly, explicitly or otherwise, that we will prevent such access.

Transfer of data outside the EEA

Please note that some recipients of data are located outside the EEA. In such cases, we only share your data with countries approved by the European Commission as providing data protection at an adequate level or enter into a legal agreement to ensure data protection at an adequate level.
